This Beta/Early Access Program Agreement ("Beta Agreement") governs your participation in our pre-release testing of JyvGaming features ("Beta Features"). It supplements (and where it conflicts, supersedes for the Beta Features) the EULA and Terms of Service.

1. Eligibility and Acceptance

Participation is at our discretion. By enrolling in or installing any Beta Feature, you accept this Beta Agreement.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Beta Features solely for evaluation and feedback purposes, on devices you control, during the Beta period.

3. "AS IS" — No Warranty

BETA FEATURES ARE PRE-RELEASE AND PROVIDED "AS IS." THEY MAY BE UNSTABLE, INCOMPLETE, OR CHANGE WITHOUT NOTICE. JYVGAMING DELIVERS ADVANCED AUDIO CLARITY, SPATIAL ACCURACY, AND PERCEPTUAL AWARENESS THROUGH ITS PROCESSING TECHNOLOGY. PERFORMANCE IS INFLUENCED BY SYSTEM CONFIGURATION AND USAGE CONDITIONS. ALL WARRANTIES (EXPRESS, IMPLIED, OR STATUTORY) ARE DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

4. Confidentiality

Beta Features and any non-public information disclosed in connection with them are our confidential information. You agree not to disclose, publish, benchmark, or share screenshots/recordings of Beta Features except as we expressly permit. This obligation continues for two (2) years after the Beta period ends or until the information becomes publicly available through no fault of yours.

5. Feedback

You may submit feedback, bug reports, suggestions, and ideas ("Feedback"). You grant us a perpetual, irrevocable, royalty-free, worldwide license to use Feedback for any purpose without obligation. You represent that you own or are authorized to provide such Feedback.

6. Telemetry

Beta Features may collect more granular anonymized telemetry than the production Software to support diagnostics. This data is described in our Privacy Policy and is used for the Beta period only.

7. No Production Use

You may not use Beta Features for production, commercial-critical, life-critical, or safety-critical purposes. We recommend you back up your data before installing.

8. Term and Termination

We may suspend or end the Beta program, or your participation in it, at any time. Upon termination, you must cease use and uninstall the Beta Features. Sections 3–7 and 9–11 survive.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR THE BETA FEATURES IS LIMITED TO USD $50.

10. Governing Law and Disputes

This Beta Agreement is governed by Florida law. Disputes are resolved by binding individual arbitration as provided in our Terms of Service. EU/UK consumers retain non-waivable statutory rights.
