Refund and Cancellation Policy

This Policy explains how cancellations and refunds work for JyvGaming Subscriptions. It is incorporated into the Terms of Service.

1. Subscription

JyvGaming is offered exclusively as a recurring monthly Subscription priced at $99.00 USD per month, billed in advance through Stripe. There is no free trial.

2. Cancellation

You may cancel your Subscription at any time from your account settings or by emailing support@jyvstream.com. Cancellation stops future renewals; access continues through the end of the current billing period.

3. Refund Eligibility — 14-Day Limited Refund

You may request a refund of your most recent monthly Subscription fee if BOTH of the following are true:

• the request is made within fourteen (14) calendar days of the most recent charge; AND
• your cumulative active usage of the Software during that 14-day window is less than four (4) hours, as measured by our license/telemetry system.

Active usage means time during which the Software is running and processing audio. If both conditions are met, the eligible refund will be issued to your original payment method within 5–10 business days. Stripe processing fees may not be refunded.

4. Non-Refundable Situations

• Active usage of four (4) hours or more during the 14-day window.
• Requests made after the 14-day window has elapsed.
• Renewal charges after the first billing cycle are non-refundable.
• Suspension or termination resulting from breach of the EULA, Terms, or AUP.
• Chargebacks or disputes filed without first contacting us in good faith.

5. EU/UK Statutory Right of Withdrawal

EU/UK consumers have a 14-day right of withdrawal under applicable consumer law. By requesting immediate performance of the contract at checkout, you acknowledge that this right of withdrawal is waived once JyvGaming has been installed, activated, and digital performance has begun. The 4-hour usage cap in Section 3 is a goodwill refund offered in addition to, and independent of, your statutory withdrawal right while it remains available. Other EU/UK consumer protections that cannot be excluded by contract continue to apply.

6. Brazil — Statutory Right of Withdrawal

Brazilian consumers have an unconditional right to cancel and receive a full refund within seven (7) calendar days of purchase under Article 49 of the Código de Defesa do Consumidor (CDC). This right applies regardless of usage and cannot be waived. To exercise this right, email support@jyvstream.com within 7 days of your purchase date with the subject “Refund Request — Brazil.” Refunds will be issued to your original payment method within 5–10 business days.

7. How to Request a Refund

Email support@jyvstream.com with the subject "Refund Request," including your account email, last four digits of the card or last billing receipt ID, and a brief reason. We will respond within 5 business days.

8. Taxes

Where refunds are issued, applicable taxes will be refunded in proportion. Where local tax authorities require otherwise, we follow their rules.

9. Updates

We may update this Policy. Refunds are evaluated under the version of the Policy in effect at the time of the relevant charge.
